Tips to avoid problems when pulled over for DUI

On Behalf of Whelan Law Office | Mar 28, 2023 | Drunk Driving |

If you want to avoid problems during a DUI stop, following some basic guidelines and being aware of your rights are important.

While it can be a scary and stressful situation, when you know what to do, it can take some of the concern out of it. Here are some tips to help you navigate a DUI stop safely.

Stay calm and respectful

When you are pulled over for a DUI stop, it’s important to remain calm and respectful toward the officer. Be polite and cooperative, and avoid arguing or being confrontational. Remember that the officer is just doing their job and trying to ensure public safety.

Follow the officer’s instructions

The officer will likely ask you to perform certain tasks, such as providing your driver’s license and registration, stepping out of the car, or performing a field sobriety test. It’s important to follow these instructions carefully, as failing to do so can escalate the situation and potentially lead to a DUI arrest.

Know your rights

You have the right to remain silent and refuse a breathalyzer test. However, remember that refusing a breathalyzer test can result in the automatic suspension of your driver’s license and may also be used against you in court.

Avoid admitting to anything

If the officer asks if you’ve been drinking, it’s best to avoid answering directly. You can simply say you would like to speak to seek guidance first or prefer not to answer.

The key to avoiding problems during a DUI stop is to remain calm, respectful and aware of your legal rights. Following these tips can help ensure a safe and smooth interaction with law enforcement.
